Military Protective and Restraining OrdersMilitary Protective and Restraining OrdersIn the civilian justice system, a restraining order or protective order is issued by a judge when a party petitions the court for protection from anotlagezu sich individual. The United States Military Justice System has its own version of restraining orders, more commonly referred to as military protective orders, but which are official conditions on liberty. Rule 304 of the Manual for Courts-Martial (MCM) allows commanders to impose pre-trial restraints under certain circumstances. Pretrial restraint is a moral or physical restraint on a parties liberty which is imposed before and during the planung of offenses. Pretrial restraint may consist of restriction in lieu of arrest, arrest, confinement, or conditions on liberty. Restriction in Lieu of Arrest Restriction in lieu of arrest is the restraint of a person by oral or written orders directing the person to remain within specified limits a restr icted person shall, unless otherwise directed, perform full military duties while restricted. Arrest Arrest is the restraint of a person by oral or written order not imposed as punishment, directing the person to remain within specified limits a person in the status of arrest may not be required to perform full military duties such as commanding or supervising personnel, serving as a guard, or bearing arms. The status of arrest automatically ends when the person is placed, by the authority who ordered the arrest or superior authority, on duty inconsistent with the status of arrest, but this shall not prevent requiring the person arrested to do ordinary cleaning or policing, or to take part in routine training and duties. Confinement Pretrial confinement is physical restraint, imposed by order of competent authority, depriving a person of freedom pending disposition of offenses. There are very strict limits on whether or not confinement is authorized. Conditions on Liberty Conditions on liberty are imposed by orders directing a person to do or refrain from doing specified acts. Such conditions may be imposed in conjunction with other forms of restraint or separately. A Military Protective Order falls under the category of Conditions on Liberty. Unlike the civilian justice system which requires a judge to grant a protective or restraining order, in the military, any commissioned officer can impose a condition on liberty on any enlisted member. Only a commanding officer of whose authority the member is subject can impose a condition on liberty on a commissioned or warrant officer. The authority to impose a condition on liberty on a commission or warrant officer cannot be delegated. However, a commanding officer may delegate to warrant, petty, and noncommissioned officers authority to impose conditions on theliberty of enlisted persons of the commanding officers command or subject to the authority of that commanding officer. For example, it is quite co mmon for commanders to delegate the authority to impose conditions on liberty to their first sergeants. Authorities cannot impose conditions on liberty on a whim. In order for the protective order to be valid, there must be reasonable belief that An offense triable by court-martial has been committedThe person to be restrained committed it andThe restraint ordered is required by the circumstances. Here are some examples of when military authorities will commonly impose a condition on liberty A commander receives information which gives him the reasonable belief that a member of his command is having an affair with a married person. The commander orders the member not to have any contact with the person until the divorce is final.A first sergeant responds to a domestic situation at the house of one of the enlisted personnel assigned to his command. Upon arrival, he views evidence that an assault occurred. The first sergeant orders the military member to sleep in the barracks that nig ht, and orders the member to have no contact with his spouse until further notice. A commissioned officer breaks up a fight between two enlisted members. She orders them not to have any contact with each other until further notice.A first sergeant is notified that one of her enlisted members has bounced several checks. She orders the enlisted member not to write any more checks until further notice.A member is waiting for a decision on whether or not he is going to be court-martialed. As such decisions sometimes take several weeks, he asks to go on leave (vacation) for a week, and the commander approves it. The commander orders the member to call his supervisor each day while on leave to check-in. While most conditions on liberty are in writing, there is no requirement that they are so. A verbal order is just as valid. Quite often an authority will impose a verbal condition on liberty and follow it up with a written order when time allows.A condition on liberty is a legal order. Hone in on His or Her Communication Style- and Challenge ItIf your boss is stuck in one particular communication style- one thats obviously not working- it may be time to push back a little. Now, Im not recommending insubordi nation or making your boss feel attacked in any way, but if youre not getting what you need to be successful, respectfully counter your manager with a different method of communication.For example, if your boss prefers to communicate via email, and those emails are filled with short, vague bullet points, try initiating a change of pace. Instead of responding electronically (which can just fuel the miscommunication fire), swing by her office to reference the message. Point out specific phrases that werent communicated effectively and ask for clarification You mentioned that your priority for me is to increase sales, but how much of an increase are you looking for, and in what timeframe?Or, if you boss tends to fire off complex, detailed information when she casually stops by your cubicle to chat, follow the conversation up with an email. Mention that you want to make sure that you have all the details you need, and ask for a short-and-sweet version of your talk, boiled down to the hi gh-level information.Encouraging your boss to embrace different communication styles will show her what works and what doesnt- when she realizes that you stop by her office every time she sends an email, shell probably get the picture that those emails arent as effective as she thinks they are.2. Repeat Instructions BackA former boss of mine once asked me to summarize and repeat whatever she said back to her. It sounds strange, but she wanted to make sure I completely understood what she said, whether she was communicating instructions, goals, or company information.It became a running joke at first When she popped her head into my office to say, Hey, Im leaving for the night, Id reply, So what youre saying is, youre going home? When your boss says something vague (Can you get me those numbers soon?), counter the statement by repeating what you think he means (Sure, I can get you the call-handling statistics from this week by the end of the day.). It may seem silly, but it will give your boss the opportunity to correct and clarify his statement, if needed (Oh, I actually meant the numbers for next months advertising budget- and I just need them by the end of the week). In the everyday hustle and bustle of the office, your boss may toss out vague instructions or information- so if you need clarification, youre going to need to separate yourself from everything else going on around you.So, send your manager an Outlook or Google Calendar invitation for a short, 15-minute meeting. In the body of the message, make sure to include the issues youd like to discuss, so your manager has some context and the ability to prepare. Then, come to the meeting with several specific points youd like to cover or questions youd like answered.With a specific chunk of time set aside, the office door closed, and all attention on you, youll be able to clarify your needs and concerns- and shell be able to focus solely on you without distraction.Depending on the size of your team, you may also be able to request that your meeting turn into a recurring event. For example, I have a weekly one-on-one meeting with my boss, which has given me the regular opportunity to bring any questions, concerns, and ideas to him- and this open forum has been great for making sure were always on the same page.Itll take a little extra effort on your part, but if you commit to helping your boss communicate better- she will. In some cases, we may not even be aware that weâre annoying our coworkers. However, itâs worth the effort to keep yourself in check. After all, everyone shares the same (sometimes cramped) office and stressful work, and the actions of one can affect the entire culture. And Iâm not just talking about gum-popping or colleagues who never wash their own dishes.Here are 12 are bad habits that Iâve experienced with a number of employees over the years. In some cases, these behaviors cost them their job. The first step to solving these habits is realizing you have them, so read on.1. Complaining.If thereâs one thing that plummets your reputation quickly, itâs complaining. We all have more work than we can do, weâve all been working late, and no, the project may not be âpart of your jobâ but I donât care. Be solution-oriented, roll up your sleeves, and contribute meaningfully to the workplace.2. Lack of punctuality.The o ccasional terrible commute or an alarm that didnât go off is a legitimate reason for being late. Whatâs not ok is consistently rolling in 15 to 30 minutes after everyone else has started a productive day. The same goes for meetings. Be on time. Itâs that simple.3. Skipping out early.The end of the day is no different than the start. Chances are, your boss is paying you for an eight-hour day and expects you to be present.4. Not owning up.Listen, weâre all doing the best we can, but that doesnât mean we arenât going to make mistakes at some point or another. Just donât play the blame game. Worse, donât try to hide the mistake, thinking your boss wonât find out. The best way to handle this situation is to be direct and apologetic, and to bring a solution that will help prevent it from happening again.5. Not asking questions.Whether youâre unsure whatâs being asked of you on a specific project, or donât know how to use a certain piece of equipment, speak up. Th at old saying, âThereâs no such thing as a stupid questionâ is true. Seek clarity to avoid wasted time and disappointing results.6. Not accepting assistance.Hoarding work or refusing to let go of something sends the message that youâre not a team player. Whatâs important is that the work gets done, and if people are offering to assist, itâs probably because you look like you need it.7. Conducting personal business at work.While the occasional personal appointment or call is perfectly fine, trawling through Instagram or shopping on Amazon is akin to stealing. Because, as noted in points 2 and 3, your company expects you in the office and working. Donât be in the office doing your own unnecessary online shopping.8. Lack of enthusiasm.Everyone has days where they feel less than motivated. But if you are consistently sullen and withdrawn, it will show in your work product and in how others perceive you. As hard as it might be sometimes, try proactively looking for somethi ng you can get excited about. Your boss will appreciate your eagerness to take on new things.9. Badmouthing the company, a coworker or your boss.Just donât. It will always come back around. That doesnât mean you have to like everyone, but you do need to get along with them.10. Lack of follow-through.If you promise to meet a deadline, keep it. If for some reason you need an extension, let people know in advance rather than after the fact.11. Having a potty mouth.In some businesses, cursing is severely frowned upon. For most, though, the occasional âbad wordâ is acceptable. However, if your stories and observations are sprinkled with four-letterwords, it sends the message that you are not only an unprofessional communicator, but that you arenât self-aware enough to know that kind of language may be offensive to your colleagues. Get out the dictionary and find new ways to express yourself.12. Lack of focus.Most of us are accustomed to multi-tasking.
